Family Law

The Federal Circuit Court of Australia (the Court) shares jurisdiction with the Family Court of Australia. The Court has jurisdiction to hear most types of family law matters, and deals with the majority of divorce applications (except in Western Australia). The Court can make the following order in relation to family law matters:

  • Parenting order
  • Financial order
  • Divorce order
  • Child Support – certain applications and appeals
  • Child Maintenance order
  • Parentage declarations and testing
  • Contravention order
  • Injunctions
  • Location and recovery order

The Family Law Act 1975 requires parties who are involved in family law proceeding, attend pre-action procedures before an order is made for parenting and financial cases.

The aim of this pre-action procedures is to provide with an opportunity for parties to improve their relationship and reach an agreement between themselves.
